A response to the arrest by the UK of General Karenzi Karake, executing a European Arrest Warrant on behalf of Spanish authorities

    Abstract

    On 20th June 2015 the UK executed a European Arrest Warrant (EAW) on behalf of Spain, relating to alleged war crimes committed by current Rwandan intelligence chief General Karenzi Karake. In this short response article, three key areas of focus are discussed;
    1. Are the described facts contained within the Spanish indictment used as the legal basis for the EAW accurate?
    2. Is the information contained within the Spanish indictment fully inclusive of all relevant contexts?
    3. Was the UK compelled to execute the arrest warrant against General Karenzi Karake?
